Welcome to the website of Helados El Güero (“Helados El Güero,” “we,” “us,” or “our”), a family-owned ice cream and antojitos shop located at 622 South Main Street, Council Bluffs, Iowa 51501. These Terms & Conditions (“Terms”) govern your use of this website (heladoselguero.com) and any content, features, or forms available on it (together, the “Site”).

By visiting or using the Site in any way, you agree to be bound by these Terms. If you do not agree with any part of these Terms, please do not use the Site. 2. Ownership of Content & Intellectual Property

Everything on this Site — including the Helados El Güero name and logo, our branding and color scheme, our photography, menu descriptions, recipes, written content, and the design and layout of the Site itself — is the property of Helados El Güero or is used with permission, and is protected by applicable copyright, trademark, and other intellectual property laws.

You may view and share pages of this Site for personal, non-commercial purposes (for example, sharing a link with a friend). Beyond that, no part of this Site may be copied, reproduced, downloaded, republished, modified, or used for any commercial purpose without our prior written permission. This includes our logo, photos of our food and shop, and our recipes, which are not to be reproduced or used by any other business or individual without our consent.

3. User-Submitted Reviews

The Site allows visitors to voluntarily submit a review of their experience with Helados El Güero, including a name, a star rating, and review text. By submitting a review, you agree to the following:

We do not guarantee that the Site will be error-free, uninterrupted, secure, or that it will meet your expectations. 5. Limitation of Liability

Helados El Güero is a small, single-location local business, and this Site is intended primarily to share information about our shop — it is not a large e-commerce platform. To the fullest extent permitted by law:

2. Our total liability to you for any claim arising from your use of the Site will not exceed one hundred dollars ($100).

6. Food & Allergen Disclaimer

Our ice cream, paletas, and antojitos are prepared in a shared kitchen and shop environment that handles milk, tree nuts, peanuts, wheat/gluten, soy, eggs, and other common allergens. While we’re happy to answer questions about ingredients, we cannot guarantee that any item is completely free of a particular allergen due to the risk of cross-contact during preparation. Ingredients, recipes, and flavor availability may change without notice.

If you or someone you’re ordering for has a food allergy or dietary restriction, please tell a staff member before ordering so we can help you make an informed choice. Customers with severe allergies should use judgment appropriate to that risk when dining with us.

7. Governing Law

These Terms are governed by the laws of the State of Iowa, without regard to its conflict of law principles. You agree that any dispute arising from these Terms or your use of the Site will be subject to the exclusive jurisdiction of the state and federal courts located in Pottawattamie County, Iowa.

8. Changes to These Terms

We may update these Terms from time to time, for example to reflect changes in our business or applicable law. When we do, we’ll update the “Last Updated” date at the top of this page. We encourage you to check back periodically. Your continued use of the Site after any changes are posted constitutes your acceptance of the revised Terms.
